Terms and Conditons
By booking a Tour with us, you acknowledge and agree that you have read and understood these
Terms and Conditions and agree to be bound by them.
Please read them carefully.
1. In these Terms and Conditions “we”, “us” and “our” mean and refer to Tours for Teachers Pty
Ltd ACN 675 418 541.
2. These terms and conditions apply to all bookings and where any person makes bookings on
behalf of other traveller(s) that person is taken to be an agent for the other traveller(s) and on
his or her authority that person will bind all such other traveller(s) to these terms and conditions.
3. Australian Consumer Law applies to these Terms & Conditions, and nothing contained in these Terms and Conditions seeks to exclude or abrogate your rights under Australian Consumer Law.
Confirmation of Booking
4. Tours will be confirmed on registration of a minimum of 8 participants. Please do not make
flight reservations until you receive official confirmation that the tour will proceed.
5. If a tour is proceeding and we accept your booking, we will issue you with a booking confirmation notice and payment schedule.
Deposit
6. To register for a tour we require you to pay a non-refundable $200.00 deposit.
Payment
7. You agree to make payments in accordance with the payment schedule provided to you at the same time as the booking confirmation notice. A failure by you to make payments when and as they fall due under the payment schedule may result in termination of your booking.
8. At your discretion, you may make lump sum payments before the dates required for payment in the payment schedule.
9. Unless expressly stated elsewhere, flights (international or domestic), visas and all meals and
beverages are NOT INCLUDED in the cost of your tour.
Refunds
10. If you cancel your booking 60 or more days prior to departure, we will refund you 50% of the
total cost of the tour less the non-refundable $200 deposit.
11. If you cancel your booking 0 to 60 days prior to departure, you are not eligible for a refund.
Cancellations by Us
12. If we cancel a tour for reasons outside our reasonable control, refunds will be less any
unrecoverable costs. We are not responsible for any incidental expenses that you may have
incurred as a result of your booking including but not limited to visas, vaccinations, travel
insurance excess or non-refundable flights.
Itinerary Changes
13. We reserve the right in our absolute discretion to amend itineraries, activities and inclusions due to operational reasons, minimum number restrictions or weather conditions. If an amendment is to take place, we will try to provide you with reasonable notice.
Travel Insurance
14. Travel insurance is NOT INCLUDED in the cost of your tour. It is a mandatory pre-condition to departure that you have and provide us with evidence of holding personal travel insurance sufficient to cover loss or damage to property, illness, injury, or not being able to travel on the confirmed date of departure. We are not responsible for any loss or damage to personal belongings or luggage, for any injury or loss of any type while on tour.
15. We are not responsible for any damage, expense or inconvenience caused by late arrival of
flights or public transport, change of schedule, strikes, vehicle breakdown, epidemics,
pandemics or other conditions. We act solely as an agent in securing accommodation and,
where applicable, public transport or other services, and to the extent permitted by law are not
liable for any loss or inconvenience in the event of any failure by any person or company to
render transportation, accommodation or other services.
Health and Safety
16. You acknowledge that the nature of the tour may include activities the participation in which
involve a degree of personal risk. We reserve the right to cancel an activity if we become
concerned for any reason for your safety or that of any other person. To the extent permitted by
law, all our liability for disruption to travel plans or mental injury is excluded.
Age Requirement
17. Tour participants must be 18 years or older at the time of the tour to participate.
Acknowledgement of Responsibility
18. You acknowledge and agree that you are solely responsible for your conduct during the tour.
This includes, but is not limited to, any actions or behaviours that may occur while participating
in tour activities.
19. You acknowledge it is your responsibility:
a. to be informed about the laws of the destination country, including but not limited to local
customs that govern the conduct of individuals within the destination country, and to comply
with those laws;
b. to manage and bring with you all mediations you require, including ensuring you have an
adequate supply for the duration of the tour and that they comply with any legal requirements
related to the possession and use of such medications in the destination country; and
c. to consume alcohol responsibly and in accordance with the laws of the destination country.
Dietary Requirements
20. You agree to disclose any dietary requirements (including food allergies) to us in writing before the start of your tour. Where we arrange meals and beverages as part of your tour, we will make all reasonable efforts to accommodate your dietary requirements, however you acknowledge and agree that we cannot always guarantee adherence in all circumstances or in all destination countries. You understand that there may be factors outside of our control, such as local availability of specific foods and ingredients or methods of food preparation may mean this will not be possible. You agree we will not be liable for any adverse effects or consequences
resulting from meals or beverages consumed by you which do not fully comply with your dietary
requirements and that you assume all risk associated with the consumption of food and
beverages during the tour.
Indemnity
You irrevocably and unconditionally agree and undertake to indemnify us, our directors, officers,
employees or agents against any claims, liabilities, losses, damages, actions, proceedings, or
expenses, including legal expenses, brought against, suffered, or incurred by us to the extent
directly caused by, arising from, or in connection with:
a) a breach by you of these terms and conditions;
b) any breach by you of any applicable law;
c) any wilful, wrongful, fraudulent, or negligent act, default, or omission by you;
d) any loss of or damage to any real or personal property of ours or any third party caused by
or arising from an act or omission of your;
e) the personal injury to or death of any person caused by or arising from an act or omission
by you.
Privacy Policy
21. Any personal information that we collect about you may be used for any purpose associated
with the operation of a tour. The information may be disclosed to our agents, service providers
or other suppliers to enable us to operate the tour. We will otherwise treat your details in
accordance with our privacy policy (available for viewing on our website
https://toursforteachers.com.au/privacy-policy).
Use of Your Image
22. Throughout our tours we may take photos that include you that we may wish to use for
promotional purposes. By joining the tour, you acknowledge and agree that we may take photos
of you and you consent to us using images of you taken during the tour for our advertising and
promotional purposes in any medium we choose. You grant us a perpetual, royalty-free,
worldwide, irrevocable licence to use such images for publicity and promotional purposes.
23. If you don’t wish to take part, please inform us before the start of your tour.
Authorisation for Medical Treatment
24. You authorise us to source and arrange medical treatment on your behalf if required during the tour. This authorisation includes, but is not limited to, emergency medical treatment,
hospitalisation, and any other medical services deemed necessary by a qualified medical
professional.
25. You are responsible for notifying us of your emergency contact person before the start of your tour. However you consent to us making decisions regarding medical treatment in situations where immediate action is required and your emergency contact person is unable to be contacted for any reason.
26. You agree to be responsible for the costs of medical treatment provided to you during the tour, including, but not limited to, costs for medical services, hospitalisation, medication, and
Transportation.
Governing Law
27. These terms and conditions are governed by the laws in the State of New South Wales,
Australia.
Terms and Conditions Updates
28. We reserve the right to alter and update these terms and conditions at any time.
